RETURNS, CANCELLATIONS & EU RIGHT OF WITHDRAWAL

At Elm82gallery, every artwork is selected, described, handled and packaged with care.

Because we specialize in collectible artwork—including limited editions, artist proofs, printer’s proofs, hand-finished works, original works and other limited-availability pieces—our return policy differs from that of a conventional retail store.

This policy explains the return, cancellation and refund procedures of Elm82gallery LLC (“Elm82gallery,” “we,” “us,” or “our”).

Nothing in this policy limits any consumer right that cannot legally be excluded or restricted.

1. GENERAL RETURN POLICY

Except where mandatory consumer law provides otherwise, purchases from Elm82gallery are considered final once an artwork has been shipped.

We strongly encourage customers to review all artwork information, photographs, dimensions, edition information, condition information and shipping details before completing a purchase.

If you would like additional photographs or information about an artwork before purchasing, please contact Elm82gallery.

This general final-sale policy does not limit applicable rights concerning:

  • artwork damaged during shipment;

  • an incorrect artwork being supplied;

  • artwork materially differing from its description;

  • legally non-conforming goods; or

  • mandatory statutory cancellation or withdrawal rights, including applicable rights of qualifying EU/EEA consumers.

2. CANCELLATIONS BEFORE SHIPMENT

If you wish to cancel an order before it has shipped, contact Elm82gallery as soon as possible at:

We will make reasonable efforts to accommodate cancellation requests received before shipment.

An order is not considered canceled until Elm82gallery confirms the cancellation.

If an order has already been transferred to the shipping carrier, it may no longer be possible to cancel the shipment.

Any mandatory statutory cancellation or withdrawal rights remain unaffected.

3. RETURNS FOR CHANGE OF MIND

For customers who do not have a mandatory statutory right of return or withdrawal, Elm82gallery generally does not accept returns solely because the purchaser:

  • changed their mind;

  • no longer wants the artwork;

  • ordered the wrong size;

  • prefers a different artwork;

  • experiences buyer's remorse;

  • finds the artwork does not suit their space; or

  • experiences differences attributable to screen or display settings where the artwork was otherwise accurately represented.

This policy reflects the collectible and often limited nature of the artwork we sell.

Nothing in this section overrides mandatory consumer-protection laws.

4. DAMAGED ARTWORK

If your artwork arrives damaged, contact Elm82gallery as soon as reasonably possible after delivery.

Please provide:

  • your name;

  • order number;

  • photographs of the exterior packaging;

  • photographs of the shipping label;

  • photographs of all internal packaging;

  • photographs of the artwork;

  • close-up photographs of the damage; and

  • a description of the issue.

Please retain all original packaging.

Do not discard the shipping tube, box, protective materials, wrapping or shipping label until Elm82gallery confirms that they are no longer required.

These materials may be necessary to process a carrier or insurance claim.

After reviewing the circumstances, Elm82gallery will determine the appropriate remedy in accordance with applicable law.

Depending upon the circumstances, this may include:

  • replacement, where available;

  • repair, where appropriate;

  • refund;

  • carrier or insurance claim; or

  • another appropriate resolution.

Because many artworks sold by Elm82gallery are limited editions, proofs, hand-finished pieces or unique works, an identical replacement may not always be available.

5. INCORRECT OR MATERIALLY MISDESCRIBED ARTWORK

If you believe you received the wrong artwork or that the artwork materially differs from its description, contact Elm82gallery promptly at Edward@elm82gallery.com

Please include photographs and a description of the issue.

We will review the matter and provide an appropriate remedy where required.

Nothing in this policy limits statutory rights concerning defective, damaged, incorrect or non-conforming goods.

EU / EEA CONSUMER RIGHTS

6. EU/EEA RIGHT OF WITHDRAWAL

If you are a consumer located in the European Union or European Economic Area and applicable consumer law provides you with a statutory right of withdrawal for your purchase, you generally have the right to withdraw from an eligible online purchase within 14 days without giving a reason.

For a purchase involving a single artwork, the withdrawal period generally expires 14 days after the day on which you, or a third party designated by you other than the carrier, acquires physical possession of the artwork.

If multiple goods from one order are delivered separately, the applicable period may begin when the final item is received, as provided by applicable law.

This statutory right exists independently of Elm82gallery's general final-sale policy.

7. HOW TO EXERCISE YOUR EU/EEA RIGHT OF WITHDRAWAL

To exercise an applicable right of withdrawal, you must clearly inform Elm82gallery of your decision before the withdrawal period expires.

Your notice should clearly state that you are withdrawing from the purchase.

You may use the Model Withdrawal Form provided at the end of this policy, but use of that form is not mandatory.

A clear statement communicating your decision to withdraw is sufficient where applicable law permits.

8. RETURN DEADLINE AFTER WITHDRAWAL

After notifying Elm82gallery that you are exercising an applicable statutory right of withdrawal, you must return the artwork without undue delay and no later than 14 days after notifying us of your decision to withdraw, unless applicable law provides otherwise.

The deadline is met if you send the artwork before the applicable 14-day return period expires.

Please contact Elm82gallery before shipping the artwork so that appropriate return instructions can be provided.

9. RETURN SHIPPING COSTS — EU/EEA WITHDRAWALS

Where an EU/EEA consumer exercises a statutory right of withdrawal solely because they have changed their mind, the consumer is responsible for the direct cost of returning the artwork, except where applicable law requires otherwise or Elm82gallery expressly agrees to bear that cost.

Because artwork may be valuable, oversized, fragile or require specialized packaging and insurance, international return-shipping costs may be significant.

Customers should consider this before completing an international purchase.

If an artwork, because of its nature, cannot normally be returned by ordinary post and applicable law requires advance information or an estimate concerning the cost of return, Elm82gallery will provide the required information before the applicable purchase.

This section does not apply in the same manner where Elm82gallery is responsible for the return because the artwork is damaged, incorrect or legally non-conforming.

10. RETURN PACKAGING

Artwork must be packaged appropriately for its return journey.

Whenever reasonably possible, we strongly recommend using the original Elm82gallery packaging because it was selected to protect the artwork during transportation.

This may include:

  • original shipping tube or box;

  • protective paper;

  • archival or protective wrapping;

  • cushioning;

  • rigid protection;

  • corner or edge protection; and

  • other protective materials supplied with the shipment.

If original packaging cannot reasonably be reused, the customer must use packaging reasonably suitable to protect the artwork during return transportation.

Customers should follow any reasonable return-packaging instructions provided by Elm82gallery.

11. CERTIFICATES & ACCOMPANYING MATERIALS

The following items, where supplied as part of the purchase, should be returned with the artwork:

  • Certificate of Authenticity;

  • artist or publisher documentation;

  • gallery documentation;

  • provenance documents;

  • edition documentation;

  • accompanying materials; and

  • other items forming part of the purchased artwork.

These materials can be important to the artwork's provenance and collectible value.

12. CONDITION OF RETURNED ARTWORK

Customers exercising a statutory withdrawal right may inspect an artwork to the extent reasonably necessary to establish its nature and characteristics.

Where permitted by applicable law, a consumer may be responsible for diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the artwork.

Examples of potentially damaging or excessive handling may include, depending upon the circumstances:

  • creasing;

  • folding;

  • tearing;

  • staining;

  • scratching;

  • marking;

  • writing on the artwork;

  • exposure to damaging moisture;

  • improper rolling;

  • removing or altering artist, publisher or gallery markings;

  • altering the artwork;

  • damaging the surface;

  • damaging or losing a Certificate of Authenticity or other documentation; or

  • handling inconsistent with reasonable inspection of the artwork.

Any deduction for diminished value will be made only where and to the extent permitted by applicable law.

13. FRAMING & ALTERATIONS

Customers should not frame, reframe, mount, laminate, trim, restore, clean, repair, modify or otherwise alter artwork that they intend to return.

Such actions may materially affect the artwork's condition or value.

Where an EU/EEA statutory withdrawal right applies, any assessment of diminished value resulting from such handling will be made only as permitted by applicable law.

14. RETURN SHIPPING METHOD

Because Elm82gallery sells collectible artwork, we strongly recommend that returned artwork be:

  • securely packaged;

  • fully trackable;

  • appropriately insured for its value; and

  • shipped using a reputable carrier.

Elm82gallery will provide the appropriate return address and reasonable return instructions after receiving a valid return or withdrawal request.

Do not send artwork to an address obtained from a shipping label, public record or previous shipment unless Elm82gallery confirms that address for the return.

15. REFUNDS FOR EU/EEA STATUTORY WITHDRAWALS

Where a valid statutory EU/EEA withdrawal applies, Elm82gallery will reimburse amounts required by applicable law, including the purchase price and, where required, the cost of the least expensive standard delivery method offered for the original purchase.

If the customer selected a more expensive delivery option than the least expensive standard delivery method offered, Elm82gallery is not required to reimburse the additional cost of that upgraded delivery option where applicable law permits.

Refunds will be made without undue delay and within the period required by applicable law.

Where legally permitted, Elm82gallery may withhold reimbursement until:

  • the artwork has been received back; or

  • the customer provides evidence that the artwork has been sent back,

whichever occurs first under applicable law.

Refunds will generally be made using the same payment method used for the original transaction unless otherwise agreed and legally permitted.

16. CUSTOMS & INTERNATIONAL RETURNS

Customers returning artwork internationally must follow Elm82gallery's return instructions carefully.

Return customs documentation should accurately identify the shipment as a returned item where legally appropriate.

Customers must not falsify customs documentation or declare inaccurate values.

Additional customs procedures may be required when artwork is returned across international borders.

Please contact Elm82gallery before shipping an international return.

17. ORIGINAL IMPORT DUTIES & TAXES

Customs duties, import VAT, brokerage charges and other amounts paid directly by a customer to a foreign government, customs authority, carrier or broker may not be refundable by Elm82gallery because those amounts may not have been collected by Elm82gallery.

Customers may need to apply directly to the applicable authority or carrier for reimbursement where such reimbursement is available.

This does not affect amounts that applicable law specifically requires Elm82gallery to refund.

18. CUSTOMIZED OR PERSONALIZED ARTWORK

Certain statutory withdrawal rights may not apply to goods made to a customer's specifications or clearly personalized, where the applicable law provides such an exception.

If Elm82gallery offers a customized or clearly personalized artwork that falls within a statutory exception, the customer will be informed where required before completing the purchase.

A work is not considered customized or personalized merely because it is a limited edition, Artist's Proof, Printer's Proof, Hors Commerce proof, numbered edition, hand-finished edition or otherwise scarce.

The applicability of an exception will depend upon the actual nature of the transaction and applicable law.

19. BUSINESS PURCHASES

Certain statutory consumer rights, including the EU/EEA consumer right of withdrawal, generally apply to individuals acting as consumers rather than purchases made primarily for business or professional purposes.

Where an artwork is purchased by or primarily on behalf of a business, gallery, dealer or other professional buyer, different rights may apply.

20. FRAUDULENT OR ABUSIVE RETURNS

Elm82gallery reserves the right to investigate suspected return fraud, including substitution of artwork, removal or substitution of documentation, false damage claims or other fraudulent conduct.

Nothing in this provision permits Elm82gallery to refuse or obstruct a legitimate statutory consumer right.

21. CHARGEBACKS & PAYMENT DISPUTES

If you experience a problem with an order, we encourage you to contact Elm82gallery first so that we can attempt to resolve the matter promptly.

Nothing in this policy prevents a customer from exercising legitimate rights available through their payment provider or applicable law.

Elm82gallery reserves the right to provide transaction, delivery, communication and other relevant documentation to a payment provider when responding to a payment dispute.

22. RELATIONSHIP TO OTHER POLICIES

This Returns, Cancellations & EU Right of Withdrawal Policy should be read together with our:

  • Terms & Conditions;

  • Shipping & Delivery Policy;

  • Privacy Policy; and

  • Cookie Policy.

If a provision of this policy conflicts with a mandatory consumer right that cannot legally be waived, the mandatory consumer right will apply.
